TERMS AND CONDITIONS

The contract concluded between Demeglio S.P.A. and the customer shall be deemed concluded upon acceptance, even if only partial, by Demeglio S.P.A.
Acceptance shall be deemed tacit if not otherwise communicated to the customer.

By placing an order, the customer declares to have read all the information provided during the purchase procedure and fully accepts the following general terms and conditions of payment transcribed below.
The customer guarantees that the data provided to Demeglio S.P.A. for registration and any purchase are truthful and correct.
If the customer is a consumer, once the online purchase procedure is completed, they shall print or save an electronic copy and in any case preserve these general terms and conditions of sale, in compliance with articles 50 and following of Legislative Decree 206/2005 on distance selling.
The customer waives any right to compensation or indemnity, as well as any contractual or non-contractual liability for direct or indirect damages to persons or property caused by the partial or total non-acceptance of an order.

WARRANTY AND ASSISTANCE
For consumers, i.e., those who purchase for purposes unrelated to their professional or entrepreneurial activity, Legislative Decree 2 February 2002, no. 24, Article 1519-bis and following of the Civil Code shall apply (two years under the conditions of the law). For other buyers, who usually purchase with a VAT number, the legal guarantees under articles 1490 and following of the Civil Code shall apply (one year under the conditions of the law). Demeglio S.P.A. guarantees only the material integrity of the products at the time of delivery. Any defects covered by the Demeglio S.P.A. warranty must be reported by the customer within 8 days from the delivery date, under penalty of forfeiture. In case of warranty coverage by Demeglio S.P.A., the customer shall only be entitled to the replacement of damaged products upon their return, with no right to claim any damages, even additional ones. Shipping costs for replacement of products due to defects are borne by Demeglio S.P.A., except in cases of willful misconduct or negligence by Demeglio S.P.A. It is hereby agreed that, if Demeglio S.P.A.'s liability to the customer is established for any reason – including non-performance, in whole or in part, of obligations assumed by Demeglio S.P.A. towards the customer resulting from the execution of an order – Demeglio S.P.A.'s liability shall not exceed the price of the products purchased by the customer for which the dispute arose. However, Demeglio S.P.A. provides no additional warranty on products made by third parties beyond that provided by individual manufacturers. Technical assistance and warranty services for these products, where provided, are performed by the individual manufacturers according to the terms and conditions stated in the documentation accompanying the products. RIGHT OF RETURN AND WITHDRAWAL
Under Article 5 of Legislative Decree 22 May 1999, no. 185, the customer (if qualified as a consumer under Article 1 letter b) has the right to withdraw from the contract and return the ordered products without penalty and without specifying the reason, within 14 working days from receipt of the products. The right of withdrawal as per the aforementioned article (Article 5 of Legislative Decree 22 May 1999, no. 185) must be exercised by the customer, under penalty of forfeiture, by sending a registered letter with return receipt to the following address: Demeglio S.P.A., located at Corso Duca degli Abruzzi 27, 10129 Turin, Italy, within 14 working days from receipt of the products, or by contacting customer service at [email protected]specifying the order number and following all instructions that will be provided for the return of the goods. All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by Demeglio S.P.A. The customer may return the product at their own expense to the following address: Demeglio S.P.A., Via del Lavoro 5, 15048, Valenza (AL), Italy. If the customer wishes to exchange the returned item for another, transport costs will be charged in this case.Cash on delivery parcels will not be accepted. Upon receipt of the products (and verification of their integrity), Demeglio S.P.A. will credit the customer with the cost of the returned products (as indicated on the invoice) as soon as possible, within 30 working days from receipt of the goods, retaining, where necessary, the amount of shipping costs which will remain definitively charged to the customer. The right of withdrawal as per the aforementioned article (Article 5 of Legislative Decree 22 May 1999, no. 185) cannot be exercised by the customer if the purchased products have been used (or damaged) by the customer themselves. The right of withdrawal does not apply to customers purchasing with a VAT number. The right of withdrawal is finally excluded in the following cases: - purchase of products packaged to customer specifications or personalized upon customer request. Demeglio S.P.A. accepts no responsibility whatsoever for damages or theft/loss of goods returned by uninsured shipments. In case of forfeiture of the right of withdrawal, Demeglio S.P.A. will return the purchased goods to the sender, charging them for the shipping costs.
